First application to lift automatic suspension under new public procurement rules successful

Amendments to the Public Contracts (Scotland) Regulations 2006 (the “Regulations”) have extended the range of remedies available to unsuccessful tenderers who are aggrieved at the manner in which a public authority has undertaken a procurement exercise and have also lowered or, in some cases, removed, the hurdles faced by litigants in raising an action against a public authority.
